GENERAL TERMS AND CONDITIONS - Vélo Adventures

The General Conditions of the Travel Disputes Committee vzw (https://www.clv-gr.be/algemene_reisvoorwaarden_nl.html) apply to this trip. You acknowledge having read and accepted them. In addition, the general conditions of Vélo Adventures are applicable. In case of contradiction, the general terms and conditions of Vélo Adventures shall prevail. The trip is organized by Vélo Adventures.

REGISTRATION AND PAYMENT CONDITIONS

By registering for the trip, you agree to pay the full sum mentioned on the specific page of your trip. Your registration is only final after payment of the “Registration Fee” of € 500.

By the payment of the “Registration Fee” you agree to the general terms and conditions of Velo Adventures.
The prices mentioned on the website and in the terms and conditions are in Euro and are taxes included.

The full sum mentioned on the websiteneed to be payed on the following due dates :

Part 1 : € 500 Registration fee (non refundable) - (niet terugvorderbaar) – need to be payed not later than 10 days after registration
Part 2 :Travel Sum - 6 month before departure
Part 3 : Travel Sum - 3 months before departure

(Part 2 and 3 are each 50% of the remaining amount after having payed the €500 reservation)

If the final payment date is not respected, the organization has the right to consider this as a cancellation.
For registrations closer to the departure date, the full travel sum must be paid in one transaction.
A participant who signs on behalf of other participants is also liable for compliance with the travel conditions by the participants he has registered.

Credit card payments: Any additional costs incurred by the relevant payment platform shall be borne by the customer.

As a participant you must fulfill the following conditions and you also agree to these conditions by signing the registration form :

Participation in Velo Adventure is open to individuals aged 18 and above. Exceptions may be requested but are only permitted with the written consent of the organization. We do not have a maximum age. As long your condition allows you to go for this challenge you are most welcome.
The participant must provide a valid international travel pass, valid until 6 months after the return of the trip.
The participant declares that he/she has or will take out a travel insurance covering all medical expenses resulting from an accident or illness during the trip, as well as any repatriation costs or additional accommodation costs if, for any reason, it proves impossible to make the planned return flight. The insurance must be valid for Africa.
The participant must have all necessary documents (registration form, medical certificate, travel pass) as well as the necessary vaccinations in order 60 calendar days before departure and upload them to there ‘My Velo Adventures’ account.
With regard to the documents to be submitted, the participant declares that all information is correct and complete. If costs arise as a result of providing incorrect information, these will be borne by the participant.
You declare your physical and mental capacity to take part in this trip. Vélo Adventures has the right to refuse your participation or to let you be examined by a doctor or a fitness center in case of doubt or in case of indications on the medical certificate.

In case of early return from the trip, Vélo Adventures reserves the right to recover the additional travel costs from the participant.
Flight dates can be changed at the participant's request, only if absolutely necessary and subject to approval by the tour operator. Changing flight dates will cost at least €180. This cost will be borne by the participant.
Velo Adventures reserves the right to pass on any price increases to participants between the time of registration and the departure date of the trip. Examples of possible price increases include transport costs due to higher fuel prices, exchange rates, tax increases, etc.

CANCELLATION CONDITIONS

Cancellation requests must be sent by email (info@veloadventure.com). The date of receipt of this email will be used to calculate the cancellation fee.
In the event of cancellation, all costs must be covered regardless of the wording below.

You may cancel the Travel Sum as follows :

up to 70 days before departure: 70% of the cost of the Tour
between 70 and 55 days before departure: 50% of the travel price is refundable
between 55 and 30 days before departure: 25% of the travel price is refundable
less than 21 days before departure: 0 % of the travel price.

In case of cancellation, the participant can transfer his registration to a third party. The participant will bear any costs associated with this.
If a participant withdraws from part of the program, no refund can be claimed.
The organization has the right to refuse a registration of a participant with no need of argumentation.

TRAVEL DURATION AND PROGRAM

The detailed Roadbook is for information purposes only and does not form part of the travel contract.
Changes in the timetables of carriers may affect the duration of the trip. The participant is not entitled to a full or partial refund of the Travel Sum if the times of departure change, as a result of any changes.
The participant who, during the trip, on his own initiative deviates from the programmed or proposed itinerary or evades supervision and, as a result, is not present at the agreed times, bears the responsibility for all additional costs that this entails, and is not entitled to a refund for services not used.

DISSOLUTION AND CHANGE BY THE TOUR OPERATOR

Local conditions, special destinations and the adventurous nature of the trips offered may mean that adjustments have to be made to the travel program before or during the trip.
Adjustments before departure may involve leaving from a different airport, travelling by a different means of transport, travelling with a different carrier, etc. In such a case, the tour operator undertakes to limit any adverse consequences for the participant as far as possible.
If a change in the program arises during the trip due to factors independent of the tour operator's will, the tour leader concerned will seek an alternative, taking into account the wishes of the participants. The tour leader will make the final decision.
Intended changes in the travel program can, in exceptional cases, result in routes, excursions, accommodation and local transport deviating from what is indicated in the publication/Roadbook.

LIABILITY OF THE TOUR OPERATOR

The tour operator is not liable for unpredictable events.
If during the trip a change in the program arises due to factors independent of the will of the tour operator, the tour leader concerned will seek an alternative, taking into account the wishes of the participants. The tour leader will make the final decision.
Intended adjustments to the travel program can, in exceptional cases, result in routes, excursions, accommodation and local transport deviating from what is indicated in the publication/Roadbook.
The tour operator is not responsible if a participant breaks the law. All consequences of not complying with local regulations will be borne by the participant.
We carefully communicate the details of the event on our platforms but can not take the full responsibility of mistakes. It is for sure not by purpose and we kindly ask to communicate us if you see any mistake in our communication.

The tour operator is not liable for unforeseen events, such as, but not limited to, new and/or unforeseen changes in regulations, accidents, strikes, flight delays or cancellations, mechanical defects, landslides, floods, epidemics, civil war, assaults, robberies, war, etc., examples of which are not exhaustive. Extra transport or accommodation costs resulting from this will therefore be borne by the participant.
The travel organizer will comply with the guidelines provided by World Health Organization as to whether or not to cancel a trip for health reasons and to the guidelines provided by the V.V.R. (Association of Flemish Travel Agents) as to whether or not to cancel a trip for safety reasons.
Costs resulting from delays such as, but not limited to: transport as a result of weather conditions, defects, change of route or cancellation of flights, possible overbooking with local airlines when first confirmed, strikes, war, ... examples of which the enumeration is not exhaustive, changes to timetables or means of transport and therefore unforeseen, cannot be recovered from the tour operator.
Given the nature of the trip, the correctness of the services provided by third parties abroad must be assessed in accordance with local customs and practices.
The tour operator is entitled to cancel the travel agreement, without being held liable for any damage in the event of force majeure, which is understood to mean abnormal and unforeseeable circumstances, independent of the will of the person invoking them, the consequences of which could not be avoided despite all precautionary measures. Force majeure is understood to include political unrest, war, epidemics, natural disasters, etc.

Privacy & Property

The data collected from the traveler will be used for organizational and marketing purposes.
By registering, you are automatically included in our database.
By participating, you give the tour operator the right to use photo and video material for promotional purposes in which you may appear as a participant. If you refuse this, you must inform the organization before the start of the trip.
The traveler agrees not to use any photos or images taken by him/her during the trip for promotional purposes without the prior consent of the organization.
The trip has been carefully planned by the organization. It is not permitted to copy this trip or pass it on to third parties, either in whole or in part.
Velo Adventure and all his sub brands Velo Afrique, Velo Friends, Velo Balkan, Velo Arena Tour, Velo Camp,… but not limited to this list; with their logos and content on different platforms are trademarks owned by Twen BV. None of it can be used or copied without permition of Twen bv.

WAIVER

The undersigned agrees, acknowledges and confirms that he/she has voluntarily entered into an agreement with Velo Adventures (the "Organization") to participate in a bicycle tour. This bike ride is a challenging personal and extreme bike ride with potential dangers and unpredictable conditions such as there are physical injury, damage or loss of property or even loss of life due to potentially dangerous conditions, arising from, among other things, traffic and road conditions that can be potentially dangerous, weather conditions, criminal acts and the possible lack of immediately available medical assistance.
The undersigned accepts all risks involved and irrevocably, unconditionally and completely waives against the Organization all claims, costs, damages, demands and liabilities of any kind that may result from participation in this bicycle tour - notwithstanding that such claims, costs, damages, demands and liabilities could be attributed to the negligence of the Organization. The undersigned also indemnifies the Organization against any claims by third parties in this regard.
The undersigned declares that he/she has or will take out insurance to cover all medical costs resulting from an accident or illness during the trip. The insurance must also cover any repatriation or additional (accommodation) costs if for any reason it proves impossible to carry out the planned return flight. The insurance must be valid for Africa (see General Conditions - Special Travel Conditions Vélo Adventures).

In the event of a breach of these terms and conditions, the court of Antwerp shall have jurisdiction.
